This Indenture dated 23rd July 1867 made between:
- Alfred Robert Tustin of Tewkesbury cooper
- William Green of Tewkesbury gentleman
- William Winterbotham of Tewkesbury gentleman
Whereas by Indenture dated 25th March 1861 expressed to be made between:
- William Henry James and John Dimery Phillips
- Said Alfred Robert Tustin
For the consideration therein mentioned the said William Henry James and John Dimery Phillips granted released and conveyed unto said Alfred Robert Tustin
All that Messuage or Tenement or Dwelling House situated in Tewkesbury on the North West of the High Street in the successive occupations of William Gardner/ Richard Heath/ John Pritchard afterwards Carew Noxon then late of Charles Dowswell and now of Alfred Robert Tustin having
A Messuage or Tenement formerly of Mr Cooper in the occupation of John Frost then in the occupation of Mary Bassett then belonging to of [blank] and occupied by Levi Clifton on South West
And A Messuage or Tenement formerly of Thomas Holland in occupation of Richard Waters afterwards in the occupation of William Townsend then belonging to Thomas Weaver and occupied by [blank] on the North East
Which said Messuage to be granted were in the year 1836 bought by one James Bennett with the Appurtenances – to hold to use of Alfred Robert Tustin forever
And Whereas by an Indenture dated 20th April 1861 and made between:
- Said Alfred Robert Tustin
- Said William Green
The Messuage Tenement and Premises comprised in the last recited Indenture were granted bargained and sold to William Green and his assigns by way of mortgage for securing £150 then advanced to said Alfred Robert Tustin by William Green after the rate of interest therein mentioned
And said Indenture contained the usual powers of recovering and enforcing payment of the principal sum and interest in default of payment
And Whereas said Alfred Robert Tustin hath contracted with the said William Winterbotham for the absolute sale to him of the said Messuage Tenement or Dwelling House and Premises for the price of £195
Now this Indenture Witnesseth purchase that in consideration of £150 paid by William Winterbotham to said William Green at request of said Alfred Robert Tustin in full payment of all principal monies and interest due to him by virtue of the said recited mortgage [receipt acknowledged] - he the said William Green doth release acquit and discharge the said hereditaments and premises
And in consideration of £45 paid to Alfred Robert Tustin by said William Winterbotham making the full purchase money of £195 [receipt acknowledged]
He the said Alfred Robert Tustin doth release grant and sell unto William Winterbotham and the said William Green at the request of said Alfred Robert Tustin doth release and confirm unto said William Winterbotham
All and singular the Messuage Tenement or Dwelling House and Premises and other hereditaments mentioned and described in and conveyed by the before recited indentures of 25th March 1861 and 20th April 1861
Together with all the houses out houses etc
Reversion and Remainders
Rents Issues Profits
Estate Right and Title of said Alfred Robert Tustin and William Green or either of them into or out of the same
To have and to hold unto said William Winterbotham absolutely discharged from the hereinbefore recited mortgage
Covenants by William Green and Alfred Robert Tustin that they have not encumbered the property
Signed by all Alfred Robert Tustin; William Green and William Winterbotham
