(16) Mortgage of Freehold Premises – Causon to Hartland – 23rd September 1828

This Indenture made 23rd September 1828 between:-

  1. William Causon of Tewkesbury victualler
  2. Nathaniel Hartland, John Allis Hartland, and Nathaniel Hartland the younger all of Tewkesbury, bankers and co-partners

Whereas under and by virtue of the last Will and Testament of William Causon the elder late of Tewkesbury aforesaid victualler deceased the said William Causon is entitled to a vested estate in fee simple free from incumbrances of and in a ONE THIRD PART or SHARE of and in several Messuages, Tenements and Dwelling Houses Hereditaments and Premises firstly hereinafter particularly described expectant on the decease of Martha Causon widow of the said William Causon the elder subject only to Two several Messuages in the entirety of the said several Messuages, Tenements and Dwelling Houses Hereditaments and Premises for securing unto George Watson of Tewkesbury bleacher his executors administrators or assigns the repayment of the several sums  of £600 and £400 with interest

And Whereas the said William Causon is also absolutely seized to him and his heirs in fee simple of the Messuage or Tenement and Premises secondly hereinafter particularly described subject only to a mortgage thereof to the said George Watson for securing unto the said George Watson his executors and assigns the sum of £150 and interest

And Whereas the said William Causon is at present indebted to the said Nathaniel Hartland, John Allis Hartland and Nathaniel Hartland the younger in their capacity as bankers in the sum of £200 as he doth hereby admit and acknowledge and having proposed to transact further business with them in such their capacity hath agreed for their satisfaction to execute to them the security hereinafter contained

Now this Indenture Witnesseth that in consideration as well of the sum of £200 so as aforesaid due and owing from the said William Causon to the said Nathaniel Hartland, John Allis Hartland and Nathaniel Hartland the younger as of the further sum of Ten Shillings  of lawful English Money to the said William Causon in hand paid by the said Nathaniel Hartland, John Allis Hartland and Nathaniel Hartland the younger (receipt acknowledged) – He the said William Causon hath subjected and charged and by these presents doth subject charge and make chargeable – All that undivided THIRD PART to which the said William Causon is entitled in fee simple expectant on the decease of the said Martha Causon of and in:

All that Messuage or Tenement or Dwelling House situate and lying in the Church Street in Tewkesbury commonly called or known by the name of THE QUART POT with the outbuildings, Malthouse and garden thereunto adjoining and belonging and now in the occupation of the said William Causon as tenant thereof to the said Martha Causon and extending from the said street called the Church Street on the fore part to the River Swilgate on the hinder part thereof having A newly erected building used as a Market House on the one side And a Messuage or Tenement in the occupation of Charles Cull on the other side

Also of and in the Messuage Cottage or Tenement and the Out offices thereof sometime since erected and built by the said Martha Causon upon part of the Garden Ground belonging to the said Messuage Tenement or Dwelling House and now in the occupation of [blank] Nutt as tenant to said Martha Causon

Also of and in All That Messuage or Tenement with the Out offices, Cottage and Stables lying behind and adjoining the same situate and lying in the Barton Street in Tewkesbury and now in the possession of Samuel Pearse Edward Evans and Thomas Rudge as tenants to the said Martha Causon extending from the said street on the forepart to a field called Oldbury Field on the hinder part and having a Messuage or Tenement next hereinafter described on the one side and Messuage or Tenement in the occupation of one John Hyett on the other side

And also of and in All That Messuage or Tenements with the Out offices and appurtenances thereof situate and being also in the Barton Street formerly in the possession or occupation of one Samuel Fletcher but now of William Winter as tenant to the said Martha Causon having a Messuage or Tenement formerly in the possession or occupation of John James but now of one Mary Moore on the one side and the last described Messuage or Tenement and Premises on the other side

And also of and in All that Tenement, Cottage or Dwelling House with the Garden Ground and appurtenances thereof situate and lying in an alley or  passage in the Barton Street Tewkesbury called Fletchers Alley in the occupation of John Burrows as tenant to the said Martha Causon having a Tenement or Dwelling house in the occupation of one James Rhoades on the East; the said Alley or Passage on the West; A Workshop now a Tenement in the occupation of Joseph Meekins on the North and Garden Ground of Thomas Fletcher on the South

And also of and in All that Messuage or Tenement with the Out offices, Malthouse and Garden lying behind and adjoining the same situate and being in the Barton Street Tewkesbury in the occupation of William Hart and William Causon as tenants to the said Martha Causon  having a Messuage or Tenement now or late of one William Iles on the West side and a Messuage or Tenement now or late of William Harris cordwainer on the East side thereof (subject nevertheless as to the whole of the hereditaments and premises hereinbefore particularly described to the payment and discharge unto said George Watson his executors and assigns of the said several principal sums of £600 and £400 and interest thereon respectively)

And also all that Messuage or Tenement with the Out offices and appurtenances thereof late in the possession of one Ann Screen widow but now of [blank] as tenant thereof to the said William Causon situate and being in Tewkesbury in the said street called the Barton Street between a Messuage or Tenement in the occupation of John Spurrier on the one side and a Messuage or Tenement of William Woodward on the other side thereof (subject only as to the last described Messuage or Tenement and Premises to the payment and discharge to said George Watson his executors and assigns of the said principal sum of £150 and interest)

Together with all Outhouses, edifices, buildings, ways, paths, passages, privileges, profits, rights, members and appurtenances whatsoever to the said several Messuages or Tenements, Hereditaments and Premises belonging or in anywise appertaining and the reversion and reversions remainder and remainders yearly and other rents, issues and  thereof. And all estate right and title interest use trust property possession benefit claim and demand whatsoever of him the said William Causon of into or out of the same. To and with the payment satisfaction and discharge unto the said Nathaniel Hartland, John Allis Hartland and Nathaniel Hartland the younger their executors administrators and assigns of all such sums of money as shall already have accrued or become due to them the said Nathaniel Hartland, John Allis Hartland and Nathaniel Hartland the younger or which shall hereafter accrue or shall become due to them or on account of advancements made by them to or on account of the said William Causon or for or by reason of any draft bills or notes discounted or negotiated with or accepted or paid by them or either of them by or on account of the said William Causon or otherwise passing into the hands with the endorsement or other guarantee of the said William Causon
