Cover: Reconveyance of Messuage and Premises in High Street – Mr Richard Homan to Mr Francis Jelleyman – 10th July 1897

Document: This Indenture dated 10th July 1897 made between:-

  1. Richard Homan of Torquay Devon chemist
  2. Francis Jelleyman of Merthyr Tydfil butcher

Supplemental to the following Deeds namely: 

An Indenture called the Principal Indenture dated 8th October 1879 between: 

  1. Francis Jelleyman 
  2. Robert Beaumont of Tewkesbury 

Being a mortgage of premises in High Street Tewkesbury then belonging to Francis Jelleyman for securing repayment to Robert Beaumont of £160 and interest @ 5%

An Indenture dated 19th November 1891 between:

  1. Frederick James Brown of Tewkesbury gentleman as personal representative of James Francis Prosser the executor of said Robert Beaumont
  2. William Tenant Jeynes and Edwin William Edgwick 

Being a transfer of said Principal Indenture and monies secured

  1. William Tenant Jeynes and Edwin William Edgwick
  2. Richard Homan

Being a further transfer of said Principal Indenture and monies secured thereby from William Tenant Jeynes and Edwin William Edgwick to said Richard Homan

An Indenture dated 9th January 1885 between:

  1. Francis Jelleyman
  2. Harry Alexander Badham gentleman

Being a mortgage (subject to a prior mortgagee for £160 and interest of certain hereditaments in Tewkesbury for securing repayment to said Harry Alexander Badham of the Principal Sum of £50 and interest

An Indenture dated 1st March 1894 between

  1. Harry Alexander Badham
  2. Richard Homan

Being a transfer of said Indenture dated 9th January 1882 and monies secured thereby from said Harry Alexander Badham to Richard Homan

An Indenture dated 9th July 1884 between:

  1. Francis Jelleyman
  2. Thomas Weaver Moore and several names attached to schedule – creditors of Francis Jelleyman

Being Indenture of Conveyance of real and Personal Estate of Francis Jelleyman unto Thomas Weaver Moore for benefit of Creditors and Mark Jelleyman (since deceased) for such a sum as would pay all expenses and 4s-0d in the pound to Creditors

An Indenture dated 26th February 1897 between:

  1. Thomas Weaver Moore
  2. Francis Jelleyman

Being a Reconveyance of all the land and hereditaments comprised in said Indenture of Mortgage made 9th July 1884

And Whereas said Mark Jelleyman made Will dated 29th June 1891 whereby he appointed his daughter Elizabeth Jelleyman and his nephew Frederick Francis Jelleyman to be the Trustees and Executors

And Whereas testator died at Tewkesbury 14th February 1894 and Will was proved at Gloucester on 12th May 1894

And Whereas disputes having arisen between said Francis Jelleyman and said Elizabeth Jelleyman and Frederick Francis Jelleyman as to ownership of the said premises comprised in Principal Indenture and said several Indentures supplemental thereto – an action was instituted in the County Court of Gloucester held at Tewkesbury entitled “A.W? Equity between Francis Jelleyman plaintiff and Richard Homan and Elizabeth Jelleyman and Frederick Francis Jelleyman defendant”

And by an Order made in the said Action 24th May 1897 that judgment be made for the Plaintiff on his claim for redemption upon Plaintiff paying to defendant Richard Homan the amount due to him for Principal and Interest and Costs therein mentioned and said Richard Homan do Reconvey the mortgaged premises to said Francis Jelleyman free of all incumbrances with payment of Costs to Defendants
