20th April 1861 – Mortgage of a Messuage and Premises in High Street Tewkesbury for securing £150 + interest – Alfred R. Tustin to Mr William Green

This Indenture made 20th April 1861 between

  1. Alfred Robert Tustin of Tewkesbury cooper
  2. William Green of Tewkesbury gent

Whereas the said Alfred Robert Tustin is seized to him and his heirs in fee simple in possession or otherwise well entitled to the hereditaments hereinafter described and assured free from all incumbrances

And Whereas said Alfred Robert Tustin having occasion for £150 hath applied to said William Green for the same which he hath agreed to do on repayment with interest

Now this Indenture Witnesseth that in consideration of £150 paid to Alfred Robert Tustin by William Green (receipt acknowledged) he, the said Alfred Robert Tustin by these presents grants bargains and releases unto said William Green –

All that Messuage or Tenement or Dwelling House situate and lying in Tewkesbury aforesaid in and on the North West side of a certain street called the High Street heretofore in the successive occupations of William Gardner; Richard Heath; John Pritchard and afterwards of Carew Noxon, late of Charles Dowswell and now of Alfred Robert Tustin and having
A Messuage or Tenement formerly of Mrs Cooper and in occupation of John Frost afterwards in occupation of Mary Bassett and now belonging to (blank) and occupied by Levi Clifton on South West Side
And a Messuage or Tenement formerly of Thomas Holland and in occupation of Richard Waters afterwards of William Townsend and now belonging to Thomas weaver and occupied by Samuel Hodges on North East Side
Together with all the outbuildings courts etc and appurtenances to the said Messuage and Hereditaments hereby conveyed belonging or appertaining

And all estate right and title trust and interest of him the said Alfred Robert Tustin and all Deeds Writings and Evidences relating to said hereditaments now in possession of Alfred Robert Tustin

To have and to hold said hereditaments and premises hereinbefore described and hereby conveyed to said William Green his heirs and assigns forever

Proviso for redemption of repayment of £150 + 5% interest
Covenant re: default of repayment for William Green to dispose
Covenant that Alfred Robert Tustin has good right and title to convey
Covenant that Alfred Robert Tustin will insure against loss by fire for at least £150 and will deliver policy to William Green
