Document: 

This Indenture Tripartite dated 12th September 1748 made between:

  1. Elizabeth Godsall of Tewkesbury widow and executor in the last Will and Testament of William Godsall late of Tewkesbury tanner deceased
  2. William Walker of Tewkesbury shoemaker
  3. Joseph Peace of Tewkesbury baker

Whereas by Indenture of Lease or Mortgage dated 28th January 1741 made between

  1. Said William Walker
  2. William Spilman of Upper Mitton in the parish of Bredon yeoman 

Said William Walker for consideration mentioned did demise unto William Spilman his executors and assigns

All that Messuage or Tenement or Half Burgage then in the occupation of said William Walker with the Garden and Backside thereto adjoining situate in Tewkesbury in the High Street otherwise Oldbury Street having
A Messuage or Tenement late in the occupation of Nicholas Allen glover but now of John Kingsbury on the North Side
A Messuage or Tenement now or late in possession of James Kingsbury on South Side
Extending itself in length from the said street on the forepart unto the land formerly of Sir Francis Russell baronet now belonging to the poor alms people on the hinder part
Together with all the outhouses houses etc etc to the said first mentioned Messuage or Tenement or Half Burgage and premises belonging or appertaining 
And the free ingress and egress and regress to and from the Pump or Well in the backside of the Messuage or Tenement on the South Side of the Messuage or Tenement hereby demised – to draw, bear and carry away water during the term and the estate hereby granted

To hold to said William Spilman his executors and assigns for the term of 1000 years subject to redemption of said William Walker to the payment of £12 and interest

And Whereas by Indenture Tripartite dated 9th November 1743 made between

  1. Said William Spilman
  2. Said William Walker
  3. John Goddard of Bredon baker

The premises were assigned to John Goddard

And Whereas by Indenture Tripartite dated 7th November 1744 made between

  1. Said John Goddard
  2. Said William Walker
  3. William Godsall of Tewkesbury

John Goddard in consideration of £40 and the further sum of £20 paid to him by the said William Godsall (receipt acknowledged) did ratify grant and confirm unto said William Godsall

All the said Messuage or Tenement or Half Burgage and Premises to hold to the said William Godsall his executors and assigns for the remainder of the term of 1000 years still to come 

And Whereas there is now due and owing to Elizabeth Godsall (as executor in the last Will and Testament of William Godsall her late husband deceased) for the principal money and interest due the sum of £67-10s-0d and the further sum of £2-10s-0d making together £70, the said William Walker hath prevailed with said Joseph Peace to advance him the same 

Now this Indenture Witnesseth that for the sum of £67-10s-0d paid to Elizabeth Godsall and £2-10s-0d to said William Walker by Joseph Peace (receipts acknowledged) – Elizabeth Godsall hath assigned and set over and said William Walker hath ratified and confirmed all and every the said Messuage Tenement or Half Burgage to the said Joseph Peace 

Proviso of redemption for the repayment of the £70 and interest
