This Indenture dated 26th May 1759 between:
- Daniel Insoll of Tewkesbury baker and Mary his wife
- George Hawkins of Tewkesbury haberdasher of hats
Witnesseth that for £14-4s-0d paid to said Daniel Insoll by said George Hawkins in full for the purchase of the equity of redemption of the freehold and inheritance of the Messuage or Tenement and hereditaments hereinafter mentioned to be granted and released (receipt acknowledged) – they the said Daniel Insoll and Mary his wife have and each of them hath granted, bargained and sold
All that messuage or Tenement with the appurtenances lying and being in Tewkesbury in the High street alias Oldbury Street formerly in possession of Nicholas Allen his undertenants or assigns afterwards of Richard Bubb and John Peace baker but now in the tenure and occupation of Joseph Heath cordwainer as tenant thereof having
A Messuage or Tenement late in possession of James Kingsbury but now of Nutt Kedwards butcher on the North Side
A Messuage or Tenement late in possession of Bartholomew Sweet but now of William Smith on South Side
And was lately purchased by said Daniel Insoll of Sarah Granchew widow and her son John Peace
Together with all the houses and outhouses and edifices whatsoever belonging or appertaining to or with the same held occupied or enjoyed
To have and to hold said Messuage or Tenement to said George Hawkins and his heirs forever
Covenant by said Daniel Insoll and Mary his wife that they had good right and title to convey and premises free from all incumbrances – (mortgage hereinafter mentioned only excepted)
And have or one of them hath, subject to such mortgage, good right and title
And also that it shall be lawful for said George Hawkins his heirs and assigns to have and enjoy and receive rents issues and profits for his benefit without interruption of Daniel Insoll and Mary his wife – free and clear and kept indemnified by him the said Daniel Insoll his heirs against all mortgages and charges whatsoever
One indenture Tripartite dated 24th of this instant May between
- Said George Hawkins
- Said Daniel Insoll
- Thomas Hughes of Tewkesbury yeoman
Purporting to be an assignment from the said George Hawkins of the said premises hereby granted and released to said Thomas Hughes his executors and assigns for the remainder of the term of 1000 years granted in such indenture mentioned IN TRUST for said George Hawkins his heirs and assigns to be as he or they shall direct to attend the inheritance
And moreover the said Daniel Insoll and Mary his wife will alone and jointly execute Fine sur cognizance de droit come ceo at Westminster
And further that said Daniel Insoll and Mary his wife will assure to said George Hawkins at his costs and charges the conveyance
