between Henry James Westfield of Tewkesbury, joiner and Mary Kate Westfield and Amelia Josephine Davis, spinster of the first part the said Mary Kate Westfield and Amelia Josephine Davis and Ellen Jane Davis of the city of Worcester spinster and Clara Jones (the wife of Alfred Jones youman carpenter of Tewkesbury) of the second part Thomas Collins of Tewkesbury builder and contractor of the third part and the said Amelia Josephine Davis of the fourth part WHEREAS Eliza Davis late of Tewkesbury aforesaid widow duly made her Will dated the 28th April last and thereby after appointing her daughters the said Mary Kate Westfield and Amelia Josephine Davis executors and trustees thereof and make various precuniary and specific bequests the said testatrix devised and bequeathed all the residue of her property both real and personal (including the said testatrix's moiety of the hereditaments herafter described) to her said trustees Upon trust to sell and convert into money the same or such part thereas should not consist of money and to stand possessed of the net proceeds of such sale and conversion in trust for her four Daughters the said parties hereto of the second part in equal shares for their own absolute use and benefit But the said testatrix declared that her said trustees should not in the lifetime of the said Amelia Josephine Davis sell her real Esatet or any part thereof until the same should have been offered in writing to the said Amelia Josephine Davis at a piece to be fixed by a valuation to be made in the usual way AND WHEREAS the said testatrix died on the 28th day of October last without having revoked or altered her said Will which was on the 25th day of November last duly proved at Gloucester by both the Executors therein named AND WHEREAS the said parties hereto of the first part have with the consent and approval of the said parties hereto of the second part (who are all of full age) agreed with the said Amelia Josephine Davis of the sale to her of the said testarix's moiety of the hereditaments herafter described for the sum of One hundred and fifty seven pounds without any such valuations aforesaid NOW this indenture WITNESSED that in consideration of the sum of One hundred and Fifty seven pounds to the said trustees now paid by the said Amelia Josephine Davis with the consent of the said Henry James Westfield (the receipt whereof the said trustees hereby acknowledge) the said --- parties hereto of the first part As trustees and with the consent and approval of the said parties hereto of the second part DO and each of them DOTH by this Deed duly acknowledged by the said Mary Kate Westfield persuant to the statute in that behalf convey unto the said Thomas Collins first ALL that the one undivided mmoiety of the said Eliza Davis deceased of and in ALL that front mmessuage or tenement situate in Church Street Tewkesbury aforesaid now in the occupation of William Meadows and also of and in ALL those two cottages or tenements situate in an Alley or Passage called Turners Court leading from Church Street aforesaid to St. Mary's street formerly the property of Nathanial Chandler [?] deceased and used by him as a Warehouse) late in the respective occupations of Ernest Mmeadows and Albert George Woodhall but now of the said Earnest Meadows and Albert G[?]reen together with the appurtenances belonging to all the said premises and in particular the free use of the said Alley or Passage called Turners Court and of the Well Pump and Privies therein in common with the owners and occupiers of the other premises in the said Alley having the right to use the same and subject to the payment of a proportionate part of the expense of keeping the same in good order and repair AND all which premises were by an indenture dated the 25th day of April 1898 and made between Elizabeth Ann Edwards of the one part and the said Elize Davis (deceased) and Amelia Josephine Davis of the other part conveyed unto and to the use of the said Eliza Davis (deceased) and Amelia Josephine Davis as tenants in common in fee simple AND SECONDLY ALL that the undivided moiety of the said Eliza Davis deeceased of and in ALL that Cottage or tenement situate in Turners Alley [??] aforesaid late iun the occupation of Ernest James but now of JJames Halling as tenant thereof AND ALSO of and in ALL that poece or parcel of garden ground adjoining thereto from East to West nine feet and in depth from North to South eighteen feet or thereabouts which said cottage or tenement and garden are bounded on the North side by Turner's Alley or Court aforesaid on the South side by a garden and premise the property of William North on the East side by two privies and a passage the thereto dividing the said garden from a messuage and premises the property of the said Thomas Collins and on the West by St. Mary's Street aforesaid AND also the free use and enjoyment of the said Alley or Court and of the Well Pump and Privies therein in common with the owners and occupiers of other --- property in the said Alley or Court formerly the property of William Hawklet but now of ___________________ paying a proprtionale part of the expense of keeping the same in good order and repair And all which said premises secondly aboove described were by an indenture dated the 5th day of July 1898 and made between Jane Romney of the one part and the said Eliza Davis (deceased) and Amelia Josephine Davis of the other part conveyed unto and to the use of the said Eliza Davis (deceased) and Amelia Josephine Davis as tenants in common in fee simple TO HOLD all the said premises hereinbefore expressed to be hereby conveyed UNTO the said Thomas Collins his heirs and assigns to the use of the said Amelia Josephine Davis in fee simple IN WITNESS whereof the said parties to these presents have hereunto se their hands and seals the day and year first before written off
