This Indenture dated 26th May 1847 (in pursuance so far as respects the Release hereinafter contained of an Act of Parliament made and passed in the 4th year of the reign of her present Majesty intituled “An Act for rendering a Release as effectual for the Conveyance of Freehold Estates as a Lease and Release by the same parties” and made between:

  1. John Moore of Tewkesbury wine merchant
  2. The Rev William Woollams Holland of Chichester clerk
  3. Thomas Greene of the same place gentleman

Whereas by Indenture of lease and release dated 30th and 31st July 1814 made between:

  1. Thomas Holland of Tewkesbury esquire and Margaret his wife; Thomas Andrews Holland of Tewkesbury gentleman and Ann his wife and said William Woollams Holland and Jane his wife
  2. Said John Moore and Samuel Jones as therein described

And of a Fine sur cognizance de droit come ceo by said Thomas Holland etc (parties of the first part) duly acknowledged and levied unto said John Moore and his heirs pursuant to a covenant contained in said Indenture of Release the hereditaments hereinafter described and intended to be hereby released were granted to the use of said John Moore and Samuel Jones their heirs and assigns UPON TRUST that they the said John Moore and Samuel Jones should and did as soon as conveniently may be after the execution of the Indenture of Release now in recital – sell and dispose of all and singular the said hereditaments

And Whereas said Samuel Jones has lately departed this life

And Whereas said John Moore as surviving Trustee in execution of the aforesaid trust hath contracted with said William Woollams Holland for the absolute sale to him of the hereditaments for £450

Now this Indenture Witnesseth that in consideration of £450 paid to said John Moore by William Woollams Holland (receipt acknowledged) and John Moore doth acquit and release and forever discharge the said William Woollams Holland his heirs and assigns to the said John Moore accordingly only to his estate right and interest and released unto said William Woollams Holland

All that Messuage or Tenement situate in Tewkesbury in a street there called the High street otherwise Oldbury Street now or late in the occupation of Thomas Haines his undertenants and assigns and which was formerly used and occupied as Two Messuages or Tenements or Half Burgages together with the Court Garden and Appurtenances to the same belonging

There follows 4 lines of writing which for the most part have been crossed through – some of the words can be deciphered as follows and appear to be referring to property in Hodges Alley which presumably had been sold and therefore did not form part of this Indenture – see note at end.

The Message tenement or dwelling house with the workshop garden and … to the said adjoining and belonging

…. Adjoining and belonging situate and lying and being in a certain alley called Hodges Alley …. Tewkesbury aforesaid and now in the respective occupation …….

Free use and liberty of ingress egress down the alley or passage belonging to the said Messuages or tenements leading to….

And also all that Messuage or Tenement with the garden and appurtenances thereto belonging situate lying and being in Tewkesbury in the Barton Street at the bottom of an Alley there called Davis Alley or Face’s Alley leading from the said Street to the Oldbury Field and now or late in the occupation of John Freeman his undertenants or assigns

And also all and singular other the Messuages or Tenements hereditaments and premises if any which were conveyed to said John Moore and Samuel Jones UPON TRUST for sale as aforesaid in and by the said hereinbefore recited Indenture of Lease and Release of 30th and 31st July 1814 and which have not been heretofore disposed of

Together with all the houses, outhouses etc and the reversion and reversions and remainder and remainders rents issues etc

To hold to him the said William Woollams Holland for such uses and subject to such powers as said William Woollams Holland shall by any deed limit and appoint

To use of William Woollams Holland for his life

To use of said Thomas Greene during the life of said William Woollams Holland IN TRUST for him the said William Woollams Holland to use of William Woollams Holland forever

Covenant by John Moore that he had not incumbered

Signed by John Moore William Woollams Holland and Thomas Greene

Note on Reverse:

This Deed is covenanted to be produced to Joseph Pitman the purchaser of the Cottage in Face’s alley or Davis alley

Signed and Delivered by the above named John Moore

The whole of the 27th and 28th lines and part of the 26th and 29th lines of the written Indenture having been first erased and the words “and which have not been heretofore sold or disposed of” between the 31st and 32nd lines of the within Indenture having been first interlined) in presence of Charles Moore solicitor Tewkesbury
