Assignment of term of 500 years – Mrs Ann Merrell to Mr Samuel Fryzer IN TRUST for Mr William Browett senior

Indenture of dated 29th September 1838 between:-

  1. Thomas Lilley of Upton on Severn Worcestershire butcher.
  2. Ann Merrell of Tewkesbury widow of Joseph Merrell late of 1333 Great Suffolk Street Surrey, accountant
  3. William Browett the elder of Tewkesbury coal merchant
  4. Samuel Fryzer of Tewkesbury gent

WHEREAS by Indenture dated 24th August 1811 between:-

  1. Henry Welling
  2. William Read

For £1000 he the said Henry Welling did grant to William Read for the term of 1000 years with proviso for redemption

AND WHEREAS 4th April 1815 the term unexpired was assigned to John Merrell IN TRUST for William Read

AND WHEREAS the said John Merrell died 11th December 1820 having made his Will dated 17th November 1820 appointing his brother Samuel Merrell; his son Joseph Merrell; and his wife Mary Merrell executors – and said Samuel Merrell and Joseph Merrell alone duly proved Will at Gloucester on 11th August next following [1821] and took on the execution of same.

AND WHEREAS Mary Merrell died 10th March 1824 having said Samuel Merrell and Joseph Merrell surviving her

AND WHEREAS said Samuel Merrell died [blank] leaving Joseph Merrell surviving and was buried at the Baptist Chapel Pershore

AND WHEREAS said Joseph Merrell died 11th June 1834 having made Will dated 7th June 1834 whereby he appointed his wife Ann Merrell sole executrix who proved Will in Court of Canterbury 24th August 1838

AND WHEREAS said William Browett the elder contracted with said Thomas lilley for the purchase of said hereditaments for £515 and by Indenture of Lease and Release already prepared -

  1. Thomas Lilley
  2. William Browett the elder

The fee simple and inheritance of said premises are intended to be conveyed to use of William Browett the elder forever – and the said William Browett the elder hath requested that residue of term to be assigned to said Samuel Fryzer UPON TRUST to attend the inheritance

NOW THIS INDENTURE WITNESSETH that Ann Merrell at request of Thomas Lilley and at the nomination of William Browett the elder hath assigned to Samuel Fryzer the remainder of the unexpired term of years in the Messuage and Malthouse etc assigned to the said John Merrell
