1815 – Indenture of Lease & Release Henry Welling to William Read

(22) Indenture of Lease for a year dated 5th April 1815 between:-

  1. Henry Fowke of Tewkesbury esq and William Moore of Tewkesbury wine merchant - trustees for the creditors of Henry Welling now or late of Tewkesbury maltster
  2. William Read of Hardwick Bredon Worcesershire, gent

  2. William Read of Hardwick Bredon Worcesershire, gent

WHEREAS by Indenture of 24th August 1811 etc etc

AND WHEREAS William Read was apprehensive of security and requested debt to be reduced – Henry Welling hands over property to Trustees Henry Fowke and William Moore to sell

Henry Fowke and William Moore sold by Public Auction at Fleece Inn Tewkesbury where highest bidding was £750

AND WHEREAS no private bidding has since been made which would counteract the mortgage debt of £850 due to William Read – with the arrears of interest of £23-8s-6d AND WHEREAS application has lately been made by said William Read to convey to him the fee simple and inheritance of said Messuage which Henry Fowke and William Moore have agreed on condition William Read pays an additional £20

AND WHEREAS upon the treaty for a conveyance of the fee simple to said William Read – it was agreed that the aforesaid mortgage term of 1000 years vested in the said William Read should be previously transferred to a Trustee of William Read's nomination to prevent a merger thereof of the inheritance of same premises. 

And the same term hath in pursuance of such agreement dated 4th April 1815 between William Read and John Merrell been assigned by William Read to John Merrell IN TRUST to attend the inheriatance.

NOW THIS INDENTURE WITNESSETH – that for £873-8s-6d being so due him said William Read and also for £20 to said Henry Fowke and William Moore – said Henry Fowke and William Moore have released:-

ALL THAT MESSUAGE formerly in tenure of Thomas Pensam gent and now or late in possession of said Henry Welling and his tenants – having a messuage heretofore of Henry Welling on the North side and a messuage of [blank] Hyett in occupation of Richard Warder shoemaker on South side and extending in length from the High Street on the forepart and to the Oldbury Field on the hinder part – which said messuage were sometime since purchased by said Henry Welling in fee simple from Thomas Pensam together with all appurtenances etc.

To have and to hold to William Read and his assigns forever
